Public Liability

If you have been involved in an accident while using a public space due to the negligence of other party, you may want to claim back for damages from the other party.  If the responsible party is not insured then your claim will have to go directly through the individual that caused that accident. In order to successfully claim you must prove the extent of loss you suffered, as a result of the incident, as well as negligence on the part of the business or property owner.

Individuals, businesses and organisations have a ‘duty of care’ to provide care for the safety of people who they can reasonably foresee will come onto their property. This covers anywhere privately and publicly owned such as shopping centres, theme park, entertainment fields, as well as public, commercial and retail property.

Compensation may cover past and future medical and rehabilitation costs; past and future lost of income; lost of enjoyment of life; and care and assistance.

To make a public liability claim, you must show that:

  • you were owed a duty of care;
  • the duty of care was breached; and
  • it could be predicted that this breach would lead to injury or damage.

If you think you have a claim, you should:

  • seek medical treatment immediately and tell your doctor how you were injured
  • keep records and receipts for any wages lost and relevant expenses
  • take photos of the injuries and where you were injured (where possible).

Public liability law can be complicated. We recognise the stress, especially when you’re unable to work, can be overwhelming. To alleviate this stress, our lawyers work on a No Win / No Fee basis. This means you won’t owe us any legal fees unless we successfully resolve your claim.
